Google Vs CCI Case:The world’s leading tech company Google (Google) has again suffered a major setback today. The Supreme Court on Thursday upheld the decision of the Competition Commission of India (CCI) to fine Google. The court has flatly refused to interfere with the interim order of the National Company Law Appellate Tribunal (NCLAT) to deposit 10 per cent fine by Google. The court has sent Google’s petition back to the tribunal. Along with this, the court has asked to decide the matter by 31 March 2023.
Google deposit 10 percent of the fine
The Supreme Court has heard on Thursday the petition filed against Google’s fine of Rs 1,337 crore. The Supreme Court has given Google India one week i.e. only 7 days to comply with the NCLAT order. A bench of Supreme Court Chief Justice DY Chandrachud and Justices PS Narasimha and JB Pardiwala upheld the penalty imposed by the Competition Commission of India (CCI) on American firm Google. what is the matter
In October 2022 last year, the CCI had also imposed a fine of about Rs 2,200 crore on Google, accusing it of hurting the competition. It may be noted that out of this a fine of Rs 1,337.76 crore was imposed for misusing the Android system used in 97 percent mobile phones. At the same time, a fine of Rs 936 crore has been imposed regarding the policies related to Play Store.
not getting relief
Earlier, Google appealed against the CCI order in the National Company Law Appellate Tribunal (NCLAT). But there is no relief from there. After which the tribunal refused to grant adjournment on the order of CCI on 4th January. The tribunal said that this appeal has been done on December 20, two months after the order came.
What Google said in the petition
The same Google said in its petition that the order of CCI is going to be effective from January 19, 2023 and it had appealed in NCLAT 1 month before this. Also said that he should not be punished for using the right of appeal.
